Equipment Hire Agreement template

Owner rents equipment to another party.

The law it is built on

SGSA 1982 ss.6-10 implied terms in hire (right to transfer possession, description, satisfactory quality, fitness). ⚠ CCA 1974 s.15: hire to an individual (including sole traders and partnerships of 2-3) capable of lasting over 3 months can be a REGULATED consumer hire agreement — unauthorised regulated hiring is an offence and the agreement may be unenforceable. This template is therefore limited to companies and business use, and says so on its face.

Before you use it

This template is not advice on your situation. What you sell, who you sell it to, what you have already agreed and what has already gone wrong decide whether a clause protects you, so read it against your own business before you issue it and change what does not fit. If the other side has already threatened a claim, the matter is a dispute and goes to AD Solicitors.

What is in it

The document has 11 numbered sections:

Filling it in

Everything in square brackets is a blank for you to complete: names, dates, figures and the terms particular to your business. Read the whole document before you send it, and check the clauses on what happens when something goes wrong against how your business operates.

If a clause does not apply, delete it rather than leaving it blank.

Common questions

How do I get this template?

The library is included in every Buzz Legal subscription, which starts at £49 +VAT a month, and is updated as the law changes. If you need only this document, we will draft it around your business for a fixed fee agreed before work starts.

Will it be right for my business?

It covers what the law requires. Have the clauses on liability, on what happens when things go wrong and on who owns what read against your own business before you rely on them.

What does a review or drafting cost?

A contract review is a fixed £249 +VAT and covers one document read in full with the risks marked up. Drafting from scratch is priced per job and agreed in writing before anything starts. Subscriptions start at £49 +VAT a month.
